STA / RESPITE TERMS AND CONDITIONS
1. Introduction
Welcome to Visionary Respite and Care. We are a registered provider of NDIS Short Term Accommodation services, offering holiday bookings for NDIS participants. By using our services, you agree to the following terms and conditions.
2. Definitions
"We", "Us", "Our" refers to Visionary Respite and Care. "You", "Your" refers to the customer or the authorized representative of the NDIS participant. "Services" refers to the accommodation and related services we provide.
3. Booking and Quotation
All bookings must be made in advance and are subject to availability. A quotation will be provided prior to the booking, which you must accept to confirm the booking. Payment will be invoiced after the completion of the trip.
4. Activity Allowance
We offer a daily activity allowance set at our discretion to ensure the best holiday experience. This allowance is provided to encourage participation in various activities but is not subject to refund if not used in the allocated way.
5. Cancellations and Refunds
Cancellations must be made 48 hours prior to the start of the booking. Cancellations made within 48 hours of the booking will be subject to a cancellation fee of 50%.
6. Payment
Payment for our services is due within 10 days after receipt of the invoice. We accept payment via NDIS funds under the Short Term Accommodation and Assistance line item.
7. Rights and Responsibilities
You are responsible for any damage caused to the property during your stay, excluding normal wear and tear. You agree to use our services in a manner consistent with all applicable laws and regulations and in accordance with these terms and conditions.
8. NDIS Rights
As an NDIS participant, you have the right to negotiate the terms of our service agreement, including service delivery, price, and cancellation policy. We aim to make our service agreement clear and understandable in line with NDIS guidelines.
9. Limitation of Liability
To the extent permitted by law, we disclaim all liability for any loss or damage, including any consequential loss or indirect damage, loss of data or profit, or damage to health, whether based in contract, tort (including negligence), or otherwise, suffered in connection with the use of our services.
10. Privacy and Confidentiality
We collect and use your personal information in accordance with our Privacy Policy. We will not share your personal information with anyone without your consent. By using our services, you agree to such collection and use.
11. Dispute Resolution
Any disputes arising out of or relating to these terms and conditions or our services will be resolved in accordance with the laws of Australia.
12. Changes to Terms and Conditions
We reserve the right to modify these terms and conditions at any time. We will notify you of any changes by posting the new terms and conditions on our website. Your continued use of our services after any such changes constitutes your acceptance of the new terms and conditions.
